Just wanted to say that the reason the situation you put forward would be considered rape is that a person under the age of consent (18 in most places) is not considered old enough to make a decision on whether or not they consent to sex. Therefore any sex with that person must be non-consensual by definition. Another interesting facet of this is that when two people under the age of consent have sex it is still considered rape and the woman is always considered the victim and the man the perpetrator.
