Hotel owners in the Erin Andrews peeping tom case accuse her of ‘forum shopping’
Erin Andrews and her legal team have asked for a stay in the case against the Nashville Marriott, one of the hotels where she was videotaped nude by Michael Barrett. Owners of the hotel have called out Andrews for what they see as “forum shopping.”
At issue is similar litigation tied up in the Circuit Court of Cook County—a lawsuit that includes several other hotels where the stalking occurred.
“Andrews’ litigation strategy is to use the claims in this Court as a backstop should she face any problems in Cook County, Illinois,” wrote Nashville attorney Aubrey B. “Trey” Harwell III, who is representing Marriott International. “She wants the ability to preserve her claims in Tennessee but only if proceeding in her shopped forum of Cook County presents an issue. A litigation strategy based on forum shopping should not be permitted.”
Not a lawyer nor did I stay at a Holiday Inn last night, but isn’t this a common occurrence when multiple lawsuits are filed? Especially ones that involve different jurisdictions?
Seems like sound legal strategy to me.
