‘Modern Warfare 3’ can be obtained right this second

So most eagerly awaited game of the year #1,422 (actually, more like the twelfth) is finally out next week, Modern Warfare 3. Next Tuesday to be in exact. But if you’re lucky, you might be near a K-Mart that has decided to break the street date!
Since yesterday, reports have been popping up all over the country of certain big Ks that have been selling copies well before they’re supposed to. And that’s great if you absolutely, really have to get you Modern Warfare on ASAP. Unfortunately, there’s a certain degree of risk involved.
At first, a Microsoft rep said via Twitter that it was totally cool to fire up the game, if you managed to get your hands on a copy…
And then a few hours later, another statement was made…
Activitision has since clarified their stance on the matter. According to Destructoid, logging onto XBLA with the copy could get you banned. Yes, even if it was a legally obtained copy. That’s nice.
No doubt MS and Activision’s lawyers have been flooding every inbox of K-Mart’s that they can get ahold of, and perhaps copies have been pulled off shelves. Hence why it’s all of a sudden a hot commodity. Especially on eBay, with the most ridiculous example being pointed out via Joystiq…
